Driver's License Suspension in Idaho

Boise Criminal Defense Lawyers Fighting for Your Driving Privileges After a DUI

The most immediate consequence of being arrested for a DUI in Idaho is the loss of your driving privileges. Whether your driver's license was immediately suspended for refusing to submit to a chemical test, or if you tested over the legal blood alcohol content (BAC) limit, your inability to legally drive can have a significant impact on your life. The ramifications may affect your education, your health, and your job.

If you have been arrested for a DUI, you have seven days to apply for an appeal of your driver's license suspension! It is imperative that you immediately retain skilled DUI counsel to defend against your charges.

Our experienced Boise criminal attorneys at Bublitz Law, P.C. can provide the assertive representation you require to fight for your right to legally drive. Don't waste your window of opportunity. Call us today at (208) 286-2111.

How to Obtain a Restricted Drivers License in Idaho

If you failed a field sobriety test and you have no prior DUIs, the Idaho Department of Transportation will automatically suspend your driver's license for 90 days. This suspension, however, will not go into effect until after a 30-day waiting period. It is during these 30 days that your Department of Transportation hearing to appeal the suspension will usually be held. If your appeal is denied, you will face an "absolute" suspension of your driver's license for at least 30 days. After this period has elapsed, you may apply for a restricted driver's license.

In order to be granted a restricted driver's license so you may legally drive to work, school, and doctor's appointments, you must do the following:

  • Provide a work verification form that details your occupation, work hours, and where your employment is located
  • Submit a letter from your doctor describing your need for medical treatment
  • Provide proof of auto liability insurance
  • Pay applicable reinstatement fees
  • Your driving record must be clear in all other states

What is The Penalty for Driving With a Suspended License in Idaho?

If you are convicted of driving with a suspended or revoked driver's license, you will be subjected to fines, have your license suspension extended for at least six additional months, and serve time in jail! Your incarceration can be up to one year, depending on if you have any prior convictions.
