DUI & DOT Hearings in Idaho

Helping You Keep Your License After a DUI Charge

Am I going to lose my license? This is one of the most common questions people ask when they have been charged with driving under the influence (DUI). While each case is different, working with a forceful and experienced Boise criminal defense attorney is the best way to protect your license.

At the Boise, Idaho, law office of Bublitz Law, P.C. we represent people who have been accused of drunk driving in Idaho. Part of our thorough and effective representation is helping them keep their driver's licenses after an arrest. We represent clients at a Department of Transportation (DOT) hearing if they failed a BAC test. We also represent clients at BAC hearings before a judge if they refused a BAC test.

You need to act fast, because you only have seven days from the time of your arrest or citation to schedule a DOT hearing. Contact us today!

What happens at a DOT hearing?

Unlike a criminal trial, a DOT hearing is simply administrative. No criminal penalties brought against you; only the decision whether or not your license will be temporarily suspended will be addressed. For first-time offenders, your hearing will be conducted by an examiner. These examiners will review all evidence gathered against you by the arresting officer.

You will have a chance to have you or your attorney speak on your behalf in defense of your license. Once the evidence has been provided and all testimonies have been heard, the DOT examiner will make a decision regarding your license suspension. If your license is suspended, you may be able to work with our team to obtain a restricted license permit so that you can still obtain transportation to and from work, school or household errands.

What Are the License Suspension Laws?

If you refuse to take a blood, breath or urine DUI test, your driver's license can be revoked for one year. If you take a DUI test and are found to have a BAC of 0.08 percent or more, you could lose your license from 90 days to 6 months on the first offense.

Commercial driver's license (CDL) holders may face special consequences when it comes to license suspension after a DUI charges. Our firm helps many people keep CDLs by taking aggressive and complete legal action.
