Idaho is a community property state. This means that all assets and debts that are acquired during the marriage will be divided equally amongst the two parties at the time of divorce. Any property or debts that the spouses may have had before getting married will remain separate property of the original owner—unless the other spouse's name is added on to the title during the marriage.

The parties may decide to split up their community property by selling and liquidating all their assets and then dividing the money. They also may choose to do so by splitting up the various properties and debts based on the value of all items. There is also the option of one spouse "buying out" the other spouse's share of an asset.

Community Property versus Separate Property

Distinguishing between community property and separate property can at times be a complicated process. If one of the spouses owns a business or another asset to which the other spouse helped with labor or funds while they were married, the situation can become especially difficult. If the spouses are unable to agree on the terms of their property division arrangement, a judge will have to make the decision for them.

To create a property division agreement, the judge will consider a number of factors:

  • The length of the marriage
  • The needs of each spouse
  • The current and possible earning abilities of each spouse
  • The preexisting terms set forth by a prenuptial agreement, if there is one in place
