In Idaho, the penalties for a marijuana crime will vary depending on the amount of marijuana found on you or in your possession, as well as the intended use for the drug. If you were found with less than 3 ounces you could be charged with a misdemeanor and face up to one year in jail. From there, the penalties greatly increase and anything equaling or over 3 ounces of marijuana could be charged as a felony crime and you may be sentenced to five years in prison.
