Sex Crimes in Idaho

Numerous sex crimes are punishable by law in Idaho. Most include sexual touching that a victim finds unwelcome and offensive, and the penalties vary based on the nature of the offense and the age of the victim. In Idaho, criminal convictions can be separated into two basic categories: misdemeanors and felonies.

Some of the most common penalties for these sex crimes in the state of Idaho, all felonies, include:

  • Rape: According to Idaho code § 18-6101, “rape” is defined as the nonconsensual penetration of another person’s oral, anal or vaginal opening. The victim is forced to perform sexual acts either against their will, or they are unable to consent for varying reasons, such as being intoxicated or unwittingly given mind-altering drugs which makes victims unable to consent. In Idaho, rape is punishable by a prison sentence of at least one year to life, depending on the nature of the crime.
  • Statutory Rape: In Idaho, 16 is the age of consent. It is a felony in Idaho for adults 18 years of age or older to perform sexual acts or to have any sexual contact with a minor under the age of 16. Statutory rape convictions in Idaho are punishable by up to 25 years in prison.
  • Enticing Children Using the Internet: Predators who entice children into sexual conduct using the internet face prison sentences up to 15 years, per Idaho code § 18-1509A.
  • Sexual Exploitation: This includes several different sex offenses perpetrated against children or certain vulnerable adults (such as those who are determined to be of an unsound mind, or those who are intellectually disabled). This law also serves to protect animals against human sexual contact (bestiality). Those charged with sexual exploitation may participate in the collection, distribution or possession of exploitative pornography of said individuals. This felony is punishable by 10-30 years in prison and/or a fine of $10,000 to $50,000.

These are not the only sex crimes punishable by law in Idaho. Other sex crimes include attempted rape, ritualized sexual abuse of a child, lewd conduct with a minor (such as indecent exposure), sexual battery, and incest, among others. In addition to any fines or prison sentence imposed upon the offender, those convicted of felony sex crimes must register as sex offenders. Sex offenders are classified in one of three ways: registered sex offenders, violent sexual predators, and juvenile sex offenders.
