Factors Considered When Determining Spousal Support

When a divorcing spouse cannot support themselves or cannot maintain a sufficient standard of living during or after a divorce, they can ask the court to be granted spousal support. The amount and duration of the payments will be based upon the specific circumstances of the marriage and divorce. An individual may be granted temporary spousal support, short-term spousal support, or permanent long-term spousal support. While there is no set formula for calculating the amount of alimony that will be granted, there are a number of other factors that are used.

When determining the amount of spousal support, the following is considered:

  • The duration of the marriage
  • The age of the spouse seeking payment
  • The physical and emotional condition of the spouse seeking payment
  • The earning ability of the spouse seeking payment
  • The paying spouse's ability to meet his or her own needs

A judge may also alter the amount of spousal support granted if they consider fault. If one spouse is responsible for the marriage ending, was abusive, or irresponsible with the marital assets, the judge may award support to the other spouse based on that.

If you wish to modify a preexisting spousal support arrangement, you must have proof demonstrating that the financial situation has changed for you or your ex-spouse. If there is not a specific end date in place, the order will end when either a spouse dies, or the receiving spouse gets remarried.
