Idaho Laws on Murder
Under Idaho law, murder, which is called homicide, is defined as the unlawful killing of a human being. To be considered murder, the killing must have been intentional or have involved extreme and prolonged pain.
Idaho law recognizes two degrees of murder:
- First-degree murder: This is the most serious charge. First-degree murder is charged when the death allegedly involves things like poison, torture or vengeance. It is also charged when a police officer has been killed, or in other serious situations.
- Second-degree murder: All other kinds of murder are of the second degree.
The penalties for a murder conviction are serious. Every person found guilty of murder of the first degree can be punished by death or life in prison. People found guilty of second-degree murder can be punished by a minimum of 10 years in prison and may face a life sentence as well.
