The Definition of Robbery
Robbery is classified as a theft crime that involves the act or threat of force or violence to steal the property of another person. This charge is considered to be serious, and can result in a prison sentence of five years to life, depending on the degree of severity. For example, if a robbery was committed by an individual who was armed, or if any kind of harm or injury was suffered by a victim, the penalties will typically be harsher.
An individual can be convicted of robbery if no actual theft took place, but there was clear and present intent to steal property. Additionally, even if no actual violence occurred, the accused can still be found guilty if the element of fear was present.
According to Idaho law, the element of fear means that:
- At the time the robbery occurred, the victim feared harm to his or her person, property, or loved ones; or
- At the time the robbery occurred, an individual in the company of the victim feared for the safety of his or her person or property.
