Understanding the Burglary Charge

Burglary is often confused with robbery, but it is important to know that it is its own, distinct crime with separate penalties. There are four elements to a burglary charge, each of which must be present for an individual to be found guilty.

The four elements include:

  • Breaking and entering – an individual partially or completely enters a building through fraud, force, or otherwise unauthorized means
  • Unauthorized – entry was made without the property owner's or resident's consent
  • Building and structure – entry was made into a building or structure, such as a home, shop, garage, or shed; simply entering a fenced yard may not constitute as burglary
  • Intent – the individual must have intended to commit a crime—most commonly theft, but this can also include arson, assault, etc.

In Idaho, a burglary can be punished by a sentence between 1-10 years of imprisonment. If the burglary was conducted using explosives, the sentence will be increased to imprisonment of 10-25 years. The exact sentence will be determined by the judge and will take into consideration the degree of severity of the crime and the involvement of weapons or harm caused.
