What Is Statutory Rape?

Under Idaho Code §18-6101, statutory rape consists of any penetration where: the victim is younger than 16 years-old and the defendant is at least 18 years-old, or. where the victim is 16 or 17 years of age and the defendant is at least 3 years older than the victim. Further, a statutory rape charge does not require any allegation that force or coercion was a factor. The potential logical problems and fairness issues with this law may be obvious, but those issues are no comfort if you have been arrested and charged with statutory rape. Jail time is a real possibility, along with irreparable damage to your reputation.

    Other forms of sexual contact with a person under 18 may not be charged as rape or statutory rape, but the consequences associated with a crime such as sexual battery of a minor, lewd and lascivious conduct or other sex offenses can be equally severe.
