Charges of Battery on a Minor
Boise Sex Defense Lawyer
The legislature has become increasingly strict when it comes to defining different types of sexual offenses based on the age range between the alleged perpetrator and the intended victim. Understanding these differences can be the difference between how you are charged, prosecuted, and if convicted, sentenced.
At Bublitz Law, P.C. our criminal defense lawyers in Boise have extensive experience handling all types of sex offense cases in which age is a factor - from statutory rape, to lewd and lascivious conduct, to cases where someone has been charged with sexual battery on a minor. No matter which one of these you are facing, our legal team can help you figure out the best way to proceed during an initial consultation.
If you have been charged with battery on a minor, speak with our attorney right away to start your defense.
What Does Battery on a Minor Charge Include?
In cases of sexual battery of a minor, these charges arise because there is at least a five-year age difference between the victim and the alleged perpetrator. For example, if the female is 16 or 17 and the male is 21 or over, the penalties are different than from other sex offenses you can be charged with.
The conduct involved does not need to involve penetration but may involve:
- Genital contact in a lascivious manner
- Solicitation of a minor for a sexual act
- Contact with a minor that does not amount to lewd conduct
- A video or photograph made of the act
Also, whether there was consent is not an issue if you are facing a sexual battery with a minor charge. The penalty for this specific charge is up to life imprisonment if the conduct is deemed lewd and you are convicted, and if not lewd then up to 25 years in prison. Based on the circumstances of your case you may qualify for a lesser reduced charge. If retained, our firm would aggressively petition for this to happen.
